Technology, 1993 and "Information as a Commodity", Vol. 55, Law and Contemporary Problems Journal, 1992. Ms. Krauthaus
earned her B.A. from the University of Illinois, and her J.D. from the University of Houston Law School in 1980.

Thomas L. Crisman is a Principal in the law firm of McKool Smith. Mr. Criman
earned his B.S. degree in Electrical Engineering, with honors, from Southern Methodist University in 1965 and his J.D. degree, with
honors, in 1969 from Georgetown University Law Center where he was Editor of the Georgetown Law Jounal. He served as Adjunct
Professor of Intellectual Property Law at Southern Methodis University Law School for eight years. Memberships include
the State Bars of Texas and Virginia, the Dallas Bar Association and the American Intellectual Property Law Association. Mr.

David A. Bateman is a partner in the Digital Integrity Group at Preston Gates & Ellis. David has more
than 20 years of experience on the cutting edge of cyber law, technology law, and intellectual property litigation. He counsels clients
in Internet safety, e-mailing compliance, and online brand protection. Working with his team at Preston Gates, he has filed some of
the nation’s first anti-phishing cases and has been lead counsel in over 200 lawsuits against spammers and other Internet malefactors.
Mr. Bateman received his B.S. in Mathematics and Economics from Yale University and his J.D. from Yale Law School.

David Bender is Of Counsel in the New York City offices of White & Case LLP, where
he specializes in litigation, counseling and transactional matters relating to information technology and intellectual
property law. Before coming to White & Case, he headed the Intellectual Property Litigation Department of AT&T. David is
Secretary/Treasurer of the Computer Law Association, and is the author of Computer Law, a four-volume treatise published
by Matthew Bender & Co., which he updates twice a year. He has also written several law review articles on various topics
relating to information technology law, patent law, and antitrust law, and has spoken on these topics at over 150 seminars
in the United States and abroad. He is a member of the Board of Editors of Year 2000 Law Report (BNA), Computer Lawyer
(Aspen Law & Business), and of Cyberspace Lawyer (Glasser LegalWorks). Before pursuing a legal career, David served as an
engineer with Ford Aerospace, and as a mathematician with Hughes Aircraft Company. He has an Sc.B. in Applied Math from
Brown University, an LL.B. from the University of Pennsylvania, and an LL.M. in Patent Law and an S.J.D. from George
Washington University.

Donald A. Cohn is a Corporate Counsel in the E. I. DuPont de Nemours and Company
Legal Department where he has practiced law for over 31 years. He is currently lead DuPont counsel for five different
groups within the DuPont organization. He also leads a global information systems, e commerce and in-house privacy
legal team with special emphasis on mergers, acquisitions and divestiture activities and electronic contracting. He
is a frequent speaker at legal seminars on a large variety of topics including legal issues arising from e-commerce,
electronic contracting, software licensing, privacy, cyber security and the use of application service providers. He
has been Co-Chair of the Annual E-Commerce Institute at Georgetown University Law Center and is the co-chair
of the ABA Business Law Section, Cyberspace subcommittee on the corporate aspects of information technology. Mr. Cohn
a 1972 graduate of the New York University Law School where he was a Moot Court Board Editor and is admitted to
practice law in the Commonwealth of Pennsylvania.

Jeff C. Dodd graduated summa cum laude from the University of Houston Law Center in 1979. He
is a partner at the firm of Mayor, Day, Caldwell & Keeton, L.L.P. in Houston. Mr. Dodd has given numerous continuing legal
education lectures on a variety of topics, far more than his wife believes to be prudent. Most of his recent presentations
relate to intellectual property and information law. But he does more than just lecture on these topics as an academic
exercise. In fact, he inhabits the recesses of "transactional intellectual property law," assisting a variety of clients in
structuring, negotiating and documenting computer hardware and software acquisition licensing, distribution and distribution
agreements, in registering and enforcing intellectual property rights with respect to various technologies, in devising data
protection strategies, among other matters.

Andrew M. Kaufman iS a partner in the Chicago office of Kirkland & Ellis where he directs the
firm's Lending and Secured Transactions practice. Practicing since 1974, Mr. Kaufman has represented both lenders and borrowers
in a wide variety of secured and unsecured financing transactions. He currently chairs the Subcommittee on Lease Financings
and Secured Transactions of the American Bar Association Business Law Section's Committee on Developments in Business
Financing, and he is a frequent speaker at seminars and conferences addressing financing issues. Mr. Kaufman is a graduate

MICHAEL K. KIRK

Mike Kirk is the Executive Director of the American Intellectual Property Law
Association (AIPLA). Prior to joining AIPLA, Mike served as Deputy Assistant Secretary of Commerce and
Deputy Commissioner of Patents and Trademarks, capping off a career of more than 30 years in the United
States Patent and Trademark Office. While at the USPTO, he led and served on numerous U.S. government
intellectual property delegations to meetings conducted under the auspices of the World Trade Organization, the
World Intellectual Property Organization, the United Nations Conference on Trade and Development, and
the Organization for Economic Cooperation and Development, as well as on bilateral negotiations on
intellectual property and trade matters. He was the Chief U.S. Negotiator on TRIPS from 1990 until the
conclusion of the Uruguay Round. He became Executive Director of AIPLA in April 1995. During his
tenure with the Association, he has testified before the United States Congress on numerous occasions, and
has continued to participate in discussions on the protection of intellectual property in a variety of
international fora. In May of this year, Mike received the National Inventors Hall of Fame Lifetime
Achievement Award for significant contributions to the American system of intellectual property
protection. A native of Florida, he has an undergraduate degree from The Citadel, a JD degree from
Georgetown University Law School, and a Masters in Public Administration from Indiana University.

WILLIAM L. LAFUZE

Mr. LaFuze is a partner with the firm of Vinson & Elkins in Houston, Texas and practices in substantially all areas of intellectual property law, with
an emphasis on electronics, oilfield equipment, and computer-related litigation. His computer-related practice has included representing companies in patent infringement, trade secret and
other intellectual property litigation. He has represented software developers, original equipment manufacturers, value-added resellers, and financial institutions in transactional and litigation
matters related to the purchase and sale of computer software and hardware. He has had substantial involvement in counseling both start-up as well as established companies in the electronics
and healthcare industries. Mr. LaFuze’s non-litigation practice also includes preparing and negotiating license agreements, including software licensing and software development
agreements; outsourcing agreements; technology development agreements; internet and e-commerce agreements; employment and consulting agreements; and contacts for the sale and
distribution of goods. In addition, he has handled intellectual property matters in numerous acquisitions, including those involving transnational issues. Mr. LaFuze’s practice also includes
trademark and patent prosecution. Mr. LaFuze is a Past President of the American Intellectual Property Law Association, the Houston Intellectual Property Law Association, the
National Inventors Hall of Fame and the National Council of Patent Law Associations. He is a Past Chair of the Computer and Intellectual Property Law Sections of the State Bar of Texas.
Mr. LaFuze graduated from the University of Texas, B.S. in Physics, in 1969 (Phi Beta Kappa; President of Sigma Pi Sigma); from Southern Methodist University, M.S. in Applied Science
(Systems Engineering), in 1971; and from The University of Texas School of Law, J.D., in 1973. He is admitted to practice in Texas; before the United States Patent and Trademark

Lew LeClair is a shareholder and General Counsel of McKool Smith, P.C., a
litigation firm headquartered in Dallas, Texas. Lew received degrees in accounting and law from the
University of Texas at Austin. While at UT Law School, Lew served on the Texas Law Review and was awarded
membership in Chancellors and Order of the Coif. After graduation, Lew clerked for the Honorable
Walter Ely, United States Court of Appeals for the Ninth Circuit. During the last 28 years, Lew has
practiced as a commercial and IP litigator and has served as lead trial counsel in more than 25 trials
on both the defense and plaintiff side. He is Board certified in Civil Trial Law by the Texas Board of

Mike McKool Jr. graduated from the University of Notre Dame magna cum laude in 1971 and received his J.D. with honors from the University of
Texas in 1974. He is a member of the Order of the Coif, Phi Beta Kappa and the Texas Law Review (1972-74). Mike has represented outside directors in litigation filed
against former directors of Dallas-based bank holding companies. In the public sector, he has been lead counsel for the City of Dallas in the Dallas public housing
discrimination and City Council redistricting cases. Mr. McKool has extensive experience as lead counsel in the trial of complex cases before both judges and juries, including
many that involve intellectual property issues. He has also served as Adjunct Professor of Law at SMU from 1981 to 1986. Mike is Chairman and President of McKool Smith.

Raymond T. Nimmer is currently the Leonard Childs Professor of Law at the University of
Houston Law Center. The author of over ten books and numerous articles, the first edition of his book The Law of
Computer Technology received a national book award from the Association of American Publishers in 1985. The third
edition was published in 1997, with the fourth edition due next year. Professor Nimmer is a frequent speaker at programs
in this country and overseas in the areas of intellectual property, business and technology law. Professor Nimmer was the
co-Reporter to the Drafting Committee on Revision of U.C.C. Article 2, including proposals to incorporate software and
other intangibles contracts within the U.C.C. He was the reporter for the Uniform Computer Information Transactions
Act (UCITA). He is a consultant to the U.S. Office of Technology Assessment, the National Science Foundation, and the
Office of the Legal Advisor of the U.S. State Department. In addition to his expertise in technology issues, he is a
recognized expert in areas of business law. He is the author of a four-volume treatise on Commercial Asset-Based Financing
and a Contributing Editor for a leading multi-volume treatise on bankruptcy law. He is admitted to practice in Illinois
and Texas as well as the United States Supreme Court. He was recently elected as a member of the American Law Institute, the

Gale R. ("Pete") Peterson is department head of the intellectual property law department of the
San Antonio firm of Cox & Smith Incorporated. Mr. Peterson served as an examiner with the United States Patent and Trademark
Office and as a technical advisor to Chief Judge Howard Markey of what is now the U.S. Court of Appeals for the Federal
Circuit. Mr. Peterson holds a degree from the University of Nebraska (Electrical Engineering) and received his Masters of
Law Degree (with highest honors) from George Washington University. He is past chairman of the Intellectual Property Law
Section of the State Bar of Texas, and past president of the Society of International Business Fellows. He is a frequent
writer and speaker on intellectual property law topics. He is the editor of Understanding Biotechnology Law: Protection,
Licensing, and Intellectual Property Policies (Marcel Dekker, 1993), author of the Texas Chapter of State Trademark and

Ken Thomas is a Legal Counsel at Texas Instruments in Dallas, Texas, where he is responsible for operational

Professor Greg Vetter received his B.S., summa cum laude, from the University of Missouri in Electrical Engineering
in 1987. He then worked in software for nine years as a project manager, product manager, and then as director of marketing, which included
a variety of intellectual property and contractual responsibilities. During these years, attending evening courses, Professor Vetter received
his M.S., summa cum laude, in Computer Science from the University of Missouri and his M.B.A., summa cum laude, from Rockhurst University. He
eft full-time employment in 1996 to attend law school. Professor Vetter received his J.D. magna cum laude from Northwestern, serving on the
Northwestern Law Review as associate articles editor. Upon graduation from Northwestern, he practiced at Kilpatrick Stockton's Raleigh, North
Carolina office for two years in the firm's technology law group. During this time he obtained registration to practice before the United States
Patent and Trademark Office as a patent attorney. Next, Professor Vetter clerked for one year for the Honorable Arthur J. Gajarsa on the United
States Court of Appeals for the Federal Circuit in Washington, D.C. Professor Vetter then joined the University of Houston Law Center faculty
in 2002. His research interests include intellectual property, patents, the role of intellectual property in commercial law, and information technology law.

Joel Wolfson is with Blank Rome’s Washington, D.C. office, specializing in transactions, corporate law, and public
